From social psychology to contemporary epistemology, scholars recognise that human beings do not encounter the world as passive observers. Rather, we interpret it through dispositions, prior beliefs, and expectations that determine what we are prepared to see and what we are quick to dismiss. As Kahneman (2011) observes, our cognitive systems are designed to conserve effort, making us prone to systematic errors of judgement\u2014especially confirmation bias. Bias, then, is not merely a distortion of perception but part of its very structure.<\/p>\n<p>When one\u2019s disposition towards another is favourable, even strong evidence of fault is met with hesitation or excuse. Conversely, when the disposition is unfavourable, the faintest suggestion of wrongdoing is treated as proof. This asymmetry reflects what researchers term motivated reasoning (Kunda, 1990): the unconscious tendency to process information in ways that reinforce existing attitudes. Fricker (2007) shows how these dynamics are not only cognitive but ethical, producing systematic injustice when credibility is unfairly granted or denied. Under suspicion, fragments of behaviour or speech\u2014stripped of context\u2014are recast as condemnation. Yet in law such fragments would carry no probative value; evidence without context is no evidence at all.<\/p>\n<p>What emerges from this imbalance is not truth but prejudice. Contemporary debates on epistemic injustice and trust underline that when the benefit of the doubt is withheld, judgement ceases to be rational and collapses into bias masquerading as justice. Medina (2013) emphasises that credibility assessments are never neutral: they reflect power, standpoint, and social imagination. It is not reality that convicts, but the predisposed view that demands conviction.<\/p>\n<p>The fault, then, does not lie with the accused but with the stance adopted towards them. To seek fairness is not to demand agreement but to insist on integrity in judgement. Sen (2009) stresses that justice must be comparative, requiring us to test judgements against reasoned impartiality rather than prejudice. Fairness demands consistency: if evidence is doubted when it contradicts prior beliefs, it must equally be doubted when it appears to confirm them. Otherwise, truth is no longer the measure\u2014bias is.<\/p>\n<p>What is required is the simple dignity of the benefit of the doubt. Without it, any verdict of guilt is not the product of reason but of prejudice, not the fruit of justice but the mask of injustice disguised as judgement. Nussbaum (2016) reminds us that a society committed to justice must cultivate generosity in judgement, for fairness is the soil in which truth can grow. Integrity requires that we look first to reason, weigh evidence impartially, and uphold the presumption of innocence.<\/p>\n<p>Where bias dominates, truth cannot prevail. But where integrity guides judgement, fairness itself becomes a form of justice. To grant the benefit of the doubt is not mere courtesy\u2014it is the minimum condition of justice, the threshold upon which truth may be pursued without distortion.
